According to some we have an impending environmental disaster due to burning fossil fuels, why would any ground be locked up over an elusive creature that can go anywhere? One that no one can seem to produce a single photo of or physical evidence. I suppose getting physical evidence of one of these things would be on the same level as finding a little green man. Maybe it would be even more incredible since we seem to have decent photos of the ships that little green men fly in.

When decisions are made in courts by juries rather than being made by professional managers, a lot of really dumb things happen. We've had any number of post-fire salvage timber sales here blocked by court decisions when the environmental groups sued USFS and timber companies in federal court. Expecting anything rational once the courts are involved in emotional issues is pretty nuts once you've seen how things really happen. :( It doesn't matter anymore what you can prove or disprove, when it gets to court, all that matters is feelings, not science.
